“Bunyi Peraturan Menteri Perhubungan Republik Indonesia Nomor 50 Tahun 2021 yang mengatur tentang Penyelenggaraan Pelabuhan Laut Pada Pasal 75 Ayat (1) tertera Jelas bahwa Setiap orang yang memanfaatkan garis pantai untuk membangun fasilitas dan/atau melakukan kegiatan tambat kapal dan bongkar muat barang atau menaikkan dan menurunkan penumpang untuk kepentingan sendiri di luar kegiatan di Pelabuhan, Terminal Khusus, dan Terminal untuk Kepentingan Sendiri wajib memiliki izin.
Mikael Menambah Dalam rumusan tersebut terdapat frasa “wajib memiliki izin” maka siapapun yang memanfaatkan garis pantai sebagaimana disebutkan di atas harus memiliki izin jika tidak memiliki izin maka tidak bisa melakukan aktivitas tersebut. Selanjutnya dalam Pasal 76 Ayat (1) diatur bahwa Untuk memperoleh izin pemanfaatan garis pantai sebagaimana dimaksud dalam Pasal 75 ayat (1), Penyelenggara Pelabuhan mengajukan permohonan kepada Direktur Jenderal. Bahwa sekalipun aktivitas tersebut untuk PLTU namun tetap harus mengantongi izin sebagaimana peraturan menteri tersebut.
“Hal ini dilakukan agar dikontrol oleh pemerintah sehingga tidak merusak lingkungan dan garis pantai tersebut. Semua harus taat hukum dan memberi contoh dan teladan bagi masyarakat. Jika hal ini terus dilakukan oleh PLTU maka ketika ada masyarakat yang melakukan hal serupa maka akan menjadi preseden buruk buat masyarakat.
Lanjut Mikael apabila terjadi kerusakan maka siapa yang bertanggung jawab. Oleh karena itu saya minta kepada pihak PLTU agar segera mengajukan izin sesuai dengan prosedur yang berlaku selain itu juga saya minta pemerintah Daerah setempat untuk memastikan perihal kebenaran tersebut jika benar terjadi maka harus dikoordinasikan baik dengan pihak PLTU maupun dengan pihak kementerian agar proses administasi berjalan dengan baik.
Sementara Kepala PLTU Ropa belum merespon Media ini ketika di Konfirmasi melalui WhatsApp Pribadi nya.
